Delayed Closing / Delayed Occupancy Claims

In a nutshell, the Tarion Delayed Closing and Delayed Occupancy Warranty protects new homebuyers in Ontario when their builder fails to meet the agreed-upon closing or occupancy date. If the builder does not give proper notice or delays beyond permitted timeframes, homeowners may be entitled to compensation of up to $7,500. This compensation covers expenses related to the delay, such as moving and storage costs, temporary accommodation, and additional living expenses. The builder must provide at least 90 days' notice for any major delay to avoid triggering compensation.
